What is individual commercial use?

Many PQAI users have asked for a way to use the platform for commercial purposes while contributing to the sustainability of PQAI. This license agreement permits such commercial use, offering a straightforward subscription model. The terms below outline permissions associated with the use of PQAI’s platform and metadata for commercial purposes.

The individual commercial use license is tied to a single user’s account and allows them to use the PQAI platform in their professional work. Examples of commercial use include, but are not limited to, activities such as:

• Commercial research and development
• Legal practice
• Data services
• Consulting reports
• Investment decisions
• Government policy development

Privacy Policy

We do not store or log your queries or search history on our servers. Your search queries are sent to the PQAI server using a secure link. No records or logs of the search queries are kept once the search results are computed and returned.

The results you bookmark/save are stored in the memory of your browser on your computer. Results saved during one search session will be available the next time you visit PQAI from the same browser.

Our website (https://projectpq.ai) and apps (https://search.projectpq.ai) use Google Analytics and Hubspot to gather some usage statistics, which allow us to better understand what you value or what interests you about our content.

How can I subscribe?

To subscribe, register for a free PQAI account, and from your account settings, you can follow the payment prompts to subscribe to the commercial license. Payment can be made via credit card, and a receipt will be emailed to you upon completion of the transaction. 

Note: Renewal payments are automatic.

Users who plan to use PQAI for commercial purposes must have commercial use permissions. By subscribing, users ensure compliance with PQAI’s terms while supporting the platform’s sustainability. The funds from commercial licenses help maintain and develop PQAI as a valuable resource for innovation and intellectual property professionals.

License Agreement

This License Agreement (the “Agreement”) is between PQAI, a subsidiary of [Your Company Name], and You (the “Customer”).

Both parties agree to abide by the terms set forth in this Agreement, in addition to the general PQAI Terms of Use. In the event of any conflict between the terms of this Agreement and the PQAI Terms of Use, the terms of this Agreement shall prevail.

1. Definitions and Interpretation

1.1 Definitions

In this Agreement:

• Agreement means the license agreement terms set out in this document.
• Commercial Use refers to any use of the PQAI platform or its metadata that results in a business or corporate outcome, whether financial or otherwise.
• Metadata refers to the data that describes, identifies, or provides information about the content available on the PQAI platform, including bibliographic data, abstracts, citations, and references.

1.2 Interpretation

(a) Unless the contrary intention appears, a reference in this Agreement to:

• This Agreement or another document includes any variation or replacement of it.
• Singular terms include the plural and vice versa.

2. Agreement Term and Renewal

This Agreement:

• Commences on the date you accept the terms by clicking “I accept” (or equivalent) in the payment form on the PQAI platform (Commencement Date).
• Continues for an annual term (12 months) from the date of subscription (Subscription Period).
• Automatically renews for additional annual terms unless you provide written notice of intent to terminate at least 30 days before the end of the current Subscription Period.

3. Access and Use of Services

3.1 Grant of License to Services
Upon payment of the applicable fees, PQAI grants you a non-exclusive, non-transferable, non-sublicensable license to use the platform for commercial purposes.

3.2 Grant of License to Metadata
PQAI grants you the right to use, reproduce, transmit, display, and distribute metadata as part of your commercial activities.

3.3 Attribution
When using PQAI data, you must:

• Retain PQAI identifiers in any shared content.
• Acknowledge PQAI by displaying its logo or proper attribution where applicable.

4. Fees and Payment

4.1 Fees
The subscription fee for the PQAI commercial use license is $1,000 USD annually. Fees are subject to review and may be adjusted for future renewals.

4.2 Payment Terms
Fees are due upon subscription, and access to commercial use features is granted upon successful payment.

5. Intellectual Property Rights

5.1 Your Background IP
You retain ownership of any intellectual property you bring to the platform.

5.2 PQAI’s Background IP
PQAI retains ownership of all intellectual property related to the platform, including metadata, software, and data structures.

6. Liability and Limitation of Liability

6.1 Exclusion of Liability
PQAI will not be liable for any indirect, consequential, or incidental damages, even if advised of the possibility of such damages.

6.2 Limitation of Liability
PQAI’s total liability for any claim related to this Agreement is limited to the amount you paid for the services in the preceding 12 months.

7. Termination

7.1 Termination for Cause
Either party may terminate the Agreement with written notice if the other party breaches the terms and fails to remedy the breach within 30 days.

7.2 Termination for Convenience
You may terminate the Agreement with 30 days’ written notice prior to the end of the Subscription Period.

7.3 Consequences of Termination
Upon termination, you must cease using all commercial features of PQAI, and the license granted under this Agreement will be revoked.

8. Governing Law and Jurisdiction

This Agreement is governed by the laws of [Your Country], and both parties agree to submit to the jurisdiction of the courts in [Your Country].
